Legal bases of the "Valentine's Day in La Gomera" promotion

First. ORGANIZING COMPANY, PURPOSE, DURATION AND SCOPE

The organization of the promotional draw is promoted by the company Serviwell S.L. (hereinafter, “Serviwell”) with address at Calle Luis Benítez Inglott, 24 - 9K, 35011, Las Palmas and CIF: B35665751.

Serviwell organizes, for promotional purposes, the "Valentine's Day in La Gomera" draw (hereinafter, the "Promotion") at an international level, to be carried out through the Internet, whose participation is open to participants of legal age.

The Promotion will start on January 30, 2022 and will end on February 6, 2022.

Notwithstanding the foregoing, Serviwell reserves the right to modify the dates of the Promotion at its convenience.

Second. PARTICIPATION REQUIREMENTS

All those people (hereinafter, the "Participants") who accept these Legal Bases and comply with the following participation rules may participate in the promotion:

- Follow the profile of Hotel Rural Triana (@hotel_rural_triana)

- Mention in the comments of the promotional publication of the giveaway one (1) friend, family member or acquaintance who has a valid Instagram profile.

- Have a valid Instagram profile and be of legal age (or have the authorization of a parent and/or legal guardian).

Participation in this contest, as well as the publication of the comments made by the Participants, may not under any circumstances violate the Instagram Community Rules, nor the Instagram Conditions of Use.

Third. PRIZES, CONDITIONS OF THE PROMOTION AND FORM OF EXCHANGE

Specifically, the winning profile will be selected by conducting a draw through the AppSorteos application, or similar, among users who have met the participation requirements. Participants who have not followed all the steps of the dynamic will be automatically eliminated from the draw. Any profiles found to be false or committing fraudulent acts will also be removed from the draw.

Once Serviwell is aware of the winning profile, it will communicate it from February 7, 2022 through the Instagram profile of Hotel Rural Triana.

The prize of this Promotion, specifically, includes:

· One (1) night at the Hotel Rural Triana (La Gomera), for two (2) people.
· Breakfast for two (2) people.

Regarding the conditions of the prize: (i) the dates are at the request of the winner and subject to availability of the activities previously mentioned on the hotel website, (ii) once the winner confirms the dates on which they wish to enjoy the prize , no changes can be made, (iii) the prize will be valid for use between February 8, 2022 and August 31, 2022, (iv) does not include expenses for flights, transportation, meals, tips, excursions, travel insurance or extra expenses not described and (v) the prizes are non-transferable and cannot be exchanged for cash or another product.

If the winner cannot be located or contacted within seven (7) calendar days following the date of communication from Serviwell, the prize will be awarded to the next in time to meet the participation requirements, and it will be understood that the first winner irrevocably waives the prize awarded. In the event that the substitute Participant cannot be located within a new period of seven (7) calendar days from the communication sent by Serviwell, the prize will be void.

Any tax charges that the acceptance of the prize could entail, as well as any other expense derived from the Promotion that is not expressly assumed by Serviwell in these Legal Bases, will be borne by the winner.

Quarter. – LIMITATIONS

Those participations that have been made after the end date of the Promotion, as well as those that do not meet the requirements established in the second section of these Legal Bases, will be considered null and void. Serviwell reserves the right to exclude from the Promotion those Participants who it suspects or detects have participated in any fraudulent manner.

If it is evident that the winners or substitutes do not meet the requirements of the Bases, or do not prove what is requested of them, their participation will be considered null and they will be automatically excluded from the Promotion, losing all rights to the prize awarded by virtue of this Promotion.

The prize awarded will not be subject to changes, alterations or compensation at the request of the winners, and cannot be exchanged for any other product or for money. Serviwell reserves the right, if there is just cause and prior legal communication, to make any changes, suspend or extend this Promotion.

A period of fifteen (15) calendar days is established from the date of awarding the prize, to make any claim motivated by this Promotion. Once fifteen (15) calendar days have elapsed from the award date, the trip will be formalized and/or managed.

It is hereby stated that the Participants do not have to pay, as a result of the proposed draw, any additional amount to Serviwell, unless the stay is modified, prior agreement between the company and the client.

Serviweel reserves, if necessary, the right to substitute the prizes for others with similar characteristics.

Fifth. – EXCLUSION OF LIABILITY.

By way of example and not limitation, Serviwell is not responsible for the following circumstances:

· The use made by the winner regarding the prize object of this Promotion.

· Damages of any nature that may be due to the temporary lack of availability or continuity of the operation of telecommunications networks.

· Of the services derived from a negligent action in the enjoyment of Serviwell services.

· Of the cases of force majeure, or fortuitous event, that could prevent the realization of the Promotion or the total or partial enjoyment of your prize. In the event that this Promotion cannot be carried out, either due to fraud detected in it, technical errors, or any other reason that is not under the control of Serviwell, and that affects the normal development of the Promotion, Serviwell reserves the right to cancel, modify, or suspend it.

Sixth.– LIMITATION ON THE CONTENT OF THE PHOTOS AND COMMENTS.

Discrimination: In no case may they be carried out with an intention that seeks to discriminate against third parties and that violates the principles of the right to honor, personal and family privacy, the image itself and the dignity of the person. Any type of discriminatory content is prohibited, whether for reasons of race, sex, religion, opinion, nationality, disability or any other personal or social circumstance.

Illegal activities: They may not include content that promotes illegal activities or that incorporates obscene or defamatory content.

Self-destructive content: It is prohibited to include content that promotes the use of narcotic substances or that could incite eating disorders and self-harm.

Violence: It is expressly prohibited to participate with photos and comments that promote violence and/or that include, without limitation, sexual violence or violence against animals and people.

Degrading content: Photos and comments that are intimidating, threatening, degrading, or in any way promote violence against a particular person or group are not allowed.

Sexual content: It is expressly prohibited to incorporate any type of sexual content.

In the event that it is proven that any of the Participants in the Promotion incurs in any of the limitations established in this section, Serviwell reserves the right to exclude said Participant from this Promotion.

Serviwell is not responsible for the damage caused by the content included in the photographs published by the Participants in the Promotion, and that at any given time may offend the sensitivity of other Participants, for which Serviwell declines all legal and judicial responsibility for all photos and descriptions.

Seventh. - PERSONAL DATA PROTECTION

Serviwell takes the protection of your privacy and personal data very seriously. Therefore, your personal information is kept secure and treated with the utmost care.

In accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data and which repeals Directive 95/46/CE (hereinafter, "RGPD") and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (hereinafter, "LOPDGDD"), each Participant with the acceptance of these Legal Bases consents that the personal data provided for participation in this Promotion be incorporated into a database owned by Serviwell to process the Participant's participation and to communicate the prize in case of that he was the winner.

Serviwell maintains adequate security in accordance with the RGPD and the LOPDGDD, and has established all the technical means at its disposal to prevent the loss, misuse, alteration, unauthorized access and theft of the data that the Participants provide through the Promotion, without prejudice to informing you that security measures on the Internet are not impregnable. Serviwell undertakes to comply with the duty of secrecy and confidentiality with respect to the personal data contained in the automated file in accordance with the applicable legislation, as well as to grant them a secure treatment in the transfers that, where appropriate, may occur.

The Participant guarantees that the personal data provided is true and is responsible for notifying Serviwell of any changes to them. The Participant will be responsible, in any case, for the veracity of the data provided, Serviwell reserving the right to exclude from the Promotion any Participant who has provided false data, without prejudice to exercising other actions that proceed by Law. It is recommended to exercise the utmost diligence in terms of Data Protection through the use of security tools, and Serviwell cannot be held responsible for theft, modification or loss of illicit data.

Eighth. – CHANGES AND ACCEPTANCE

Serviwell reserves the right to modify or expand these promotional bases, to the extent that it does not harm or impair the rights of the Participants in the Promotion.

Participation in the Promotion implies full acceptance of these Legal Bases by the Participants who enroll in this Promotion, which will be available to anyone who wishes to consult them.

Ninth. – APPLICABLE LEGISLATION AND JURISDICTION

These Legal Bases will be interpreted and governed in accordance with Spanish law. The Courts and Tribunals of the city of residence of the Participants will be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or compliance with these bases.
